Terms of Service

1. Overview
These Terms of Service ("Terms") govern your use of services and products offered by Sinclair Electrical & Refrigeration ("we", "our", "us"). By engaging with our services — including solar and heat pump installations, electrical work, and related packages — you agree to these Terms.
2. Services Offered
We provide supply and installation of residential, commercial, and agricultural electrical systems, including solar energy systems and heat pump units. Our services include on-site consultations, system design, installation, maintenance, and aftercare.
3. Booking & Consultation
You may request a free consultation via our website or phone. Quotes are based on information provided and may be subject to change following an on-site assessment. Acceptance of a quote forms a binding agreement to proceed.
4. Pricing & Payments
All pricing is in NZD and includes GST unless stated otherwise. Payment terms are typically a 50% deposit with balance due on completion. We accept bank transfer and other methods by arrangement. Delays in payment may incur interest or collection costs.
5. Cancellations & Refunds
You may cancel your installation up to 5 business days prior without charge. Cancellations within 5 days may incur costs based on work completed or equipment ordered. Refunds are assessed case-by-case in line with the Consumer Guarantees Act.
6. Warranties
- Heat Pumps: 5–10 Year Manufacturer Warranty + 5-Year Sinclair Installation Guarantee
- Solar Systems: 10-Year Inverter Warranty (e.g. Sungrow), and panel warranties as specified
Warranty claims must be made promptly. We are not liable for manufacturer delays or exclusions beyond our control.
7. System Use & Limitations
Products are to be used for residential or commercial energy applications only. We are not responsible for damage caused by misuse, unauthorised modification, or failure to follow usage instructions.
8. Liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages. This includes but is not limited to power savings estimates, third-party software issues (e.g. app control), or performance fluctuations due to weather or site-specific factors.
9. Third-Party Products & Services
We supply and install equipment from trusted brands like Daikin, Mitsubishi, Panasonic, Hitachi, Sungrow, and TBB Power. Manufacturer terms and warranties apply. We do not guarantee third-party services like finance, rebates, or mobile app platforms.
10. Intellectual Property
All website content, brand materials, and package designs remain our intellectual property. Do not copy, reuse, or reproduce our content without permission.
11. Governing Law
These Terms are governed by New Zealand law. Any disputes will be resolved under the jurisdiction of New Zealand courts.
12. Changes to Terms
We may update these Terms from time to time. Any updates will be posted on our website with the new effective date.
